By engaging with Aklikx Technologies LLC (“Company,” “we,” “us,” “our,” or “Aklikx”) for digital marketing services, you (“Client,” “you,” or “your”) agree to comply with and be bound by these Terms & Conditions.
Services Overview
Aklikx provides digital marketing services including but not limited to:
- Website design and development
- Social media management and posting
- Google Ads campaign management
- Weekly content design (4 posts minimum)
- Website maintenance and updates
- Social media content strategy
Client Responsibilities
You agree to:
- Provide accurate business information and brand guidelines
- Grant access to social media accounts and website (if applicable)
- Respond promptly to communication regarding campaigns
- Approve content before posting (if agreed upon)
- Provide necessary login credentials securely
- Ensure you own or have rights to all provided content
SMS Notifications & Communications
You agree to receive SMS notifications regarding:
- Social media post confirmations and scheduling updates
- Website updates and changes
- Weekly content notifications and status updates
- Campaign performance alerts
- Service announcements
SMS Terms:
- You have provided explicit consent to receive SMS messages
- Reply STOP to opt-out of SMS notifications at any time
- Reply HELP for customer support
- Message frequency may vary
- Standard message and data rates apply (carrier charges)
- We will not share your phone number with third parties for marketing
- SMS is sent via Vonage SMS platform
- Carriers are not liable for delayed or undelivered messages
Payment Terms
- Payment terms and pricing will be outlined in a separate Service Agreement
- Late payments may result in service suspension
- All prices are in USD unless otherwise agreed
Intellectual Property
- Content created by Aklikx for your campaigns remains the intellectual property of Aklikx unless otherwise specified in writing
- You retain rights to your company’s original brand assets and content
- You grant Aklikx a license to use created content for your business purposes
Service Limitations
- Aklikx does not guarantee specific results or rankings
- Social media platform changes may affect campaign performance
- We are not responsible for third-party platform outages or policy changes
- Content approval delays may affect posting schedules
Confidentiality
Both parties agree to maintain confidentiality of:
- Business strategies and analytics
- Unpublished content and campaigns
- Login credentials and sensitive business information
Limitation of Liability
To the fullest extent permitted by law, Aklikx shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of revenue or business opportunities
- Third-party platform policy violations
- Content removal or account suspension by social media platforms
Important Notice
You acknowledge that Aklikx is not responsible for circumstances beyond our control, including third-party platform decisions and policy changes.
Termination
Either party may terminate services with 30 days written notice. Upon termination:
- Client regains ownership/control of all accounts
- Aklikx will provide transition assistance
- Outstanding payments remain due
Modifications
Aklikx reserves the right to modify these terms with 30 days notice. Continued use of services constitutes acceptance of modified terms.
Governing Law
These Terms & Conditions are governed by the laws of the State of New York, United States.
